Release And Waiver of Liability,
Assumption of Risk and Indemnity Agreement (“RELEASE”)

IN CONSIDERATION for me and my team, teammates and/or club, being provided the opportunity to participate in match play, tournaments or events, organized or available through the efforts of the Cricket Milwaukee, its directors, officers, agents and/or employees (herein, collectively referred to as “CM”), I, for myself, family, heirs, personal representatives and all others, I HEREBY AGREE AND WARRANT AS FOLLOWS:

1. I REPRESENT AND ASSURE ALL that I understand participating in such Activities may involve vigorous physical exertion and I am in good physical condition and physically able to participate in the “Activities”. 
2. I HEREBY EXPRESSLY RELEASE, WAIVE, DISCHARGE (AND PROMISE NOT TO SUE) CM FROM ALL LIABILITY, TO THE UNDERSIGNED, as well as my family, heirs, personal representatives and all others FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS ON ACCOUNT OF INJURY TO PERSON OR PROPERTY OR DEATH ARISING OUT OF, OR RELATED TO, CM ACTIVITIES WHETHER OR NOT I AM ACTIVELY PARTICIPATING AT THE TIME IN MATCH PLAY, THE TOURNAMENT OR EVENT, EVEN IF CAUSED BY THE NEGLIGENCE OF CM OR OTHERWISE (but not including intentional or reckless acts of an individual(s)).  I HEREBY ALSO AGREE TO INDEMNIFY, AND HOLD HARMLESS, CM FROM ANY LOSS, LIABILITY, DAMAGE, OR COST I may incur arising out of or related to THE ACTIVITIES WHETHER CAUSED BY THE NEGLIGENCE OF CM (but not including intentional or reckless acts of the releases).
3. I HEREBY ACCEPT THE RISK AND ASSUME ALL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to THE ACTIVITIES whether caused by the NEGLIGENCE OF CM AND/OR ALL RELATED INDIVIDUALS or otherwise (but not including intentional or reckless acts of the releases).  I furthermore acknowledge, under Wis. Stat. § 895.525, that I have a responsibility to act within the limits of my ability, to heed all warnings regarding participation in the Activity, to maintain control of my person, equipment or devices, and to refrain from acting in any manner that may cause or contribute to death or injury to myself or others.  I EXPRESSLY ACKNOWLEDGE MY RESPONSIBILITY TO COMPLY WITH THE RULES OF CM, as well as rules prevailing for the game of cricket, the tournament and the event, AND EXPRESSLY AGREE TO USE REASONABLE EFFORTS TO ENFORCE COMPLIANCE OF THE SAME BY MEMBERS OF MY TEAM, MY CLUB, FRIENDS, FAMILY MEMBERS AND FANS.
4. I HEREBY ACKNOWLEDGE that prior to signing this Release, I have had the opportunity to contact a representative of CM to discuss and/or bargain regarding any of the terms set forth herein.  I ALSO ACKNOWLEDGE that if any provision of this RELEASE IS FOUND UNENFORCEABLE, I AGREE THE BALANCE HEREOF IS ENFORCEABLE AS PERMITTED BY WISCONSIN LAW.
5. I HERE BY ACCEPT that CM has all the right to decide cricket playing conditions (bat, ball, ground, and schedule). Also it can take necessary action on me if I fail to follow the guidelines provided by the CM.
6. ​In exchange to consideration for being a participant of event held by CM I assume all the risks and further release, waive, discharge its members and volunteers for any and all liability for any loss or damage, and any claim or demands on account of any property damage or any injury to, or an illness or the death of, the undersigned who may contract or suspect to have contracted COVID19, directly or indirectly.

I HAVE READ THIS RELEASE AND FULLY UNDERSTAND BY MY SIGNATURE I HAVE GIVEN UP SUBSTANTIAL RIGHTS, HAVE SIGNED FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME.
I INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
I AGREE THAT IN THE EVENT A COPY OF THIS RELEASE IS PROVIDED TO ME OR A REPRESENTATIVE OF MY TEAM OR CLUB, AND I FAIL TO PROPERLY SIGN THIS AGREEMENT, OR FAIL TO PROVIDE THIS AGREEMENT TO CM, BY THE ACT OF MY PARTICIPATION IN THE ACTIVITIES DEFINED HEREIN, THE CM AND ALL RELATED INDIVIDUALS' MAY REASONABLY RELY ON MY ACTIONS AS EVIDENCE I HAVE AGREED TO ALL TERMS SET FORTH IN THIS RELEASE.
