Accident Waiver and Release of Liability Agreement v1.3

I hereby assume all of the risks of participating in any and all events and cricket tournaments organized and/or conducted by Hamzah Cricket Community (“HCC”), including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault.

I understand that some HCC events and cricket tournaments will be conducted on Hamzah Islamic Center’s (“HIC”) property and HIC is no way responsible for any eventuality that may arise from HCC events and cricket tournaments. Furthermore, I understand that HIC property where HCC events and cricket tournaments may be conducted, has creeks, above-ground cement septic/drainage tanks, barbed wires and metal fences that mark the property line, hill by the gazebo that provides entry to the greater flatter field, rough and bare patches with small rocks and stones. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS that come with participating in HCC events and cricket tournaments conducted at HIC property, both known and unknown, and assume full responsibility for my participation.

[18+ Year-Olds] I certify that I am at least eighteen years old and I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in HCC events and cricket tournaments. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the HCC in which I may participate and that it will govern my actions and responsibilities at said events and cricket tournaments.

[16-17-Year-Old] I certify that my parents have signed (either my mother or my father) HCC’s “Affidavit to Allow a Minor to Play Cricket” and the affidavit has been accepted by HCC Managing Organization prior to my registration. I certify that I am physically fit and have not been advised not to participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in HCC events and cricket tournaments. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the HCC in which I may participate and that it will govern my actions and responsibilities at said events and cricket tournaments. Moreover, as outlined in the HCC’s “Affidavit to Allow a Minor to Play Cricket,” I will do my best to play with all safety equipment to minimize the risk of injury. Lastly, I hereby acknowledge that I will not perform any umpiring duties for any matches at HCC.

I acknowledge that HCC events and cricket tournaments may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration.

In consideration of my application and permitting me to participate in HCC events and cricket tournaments, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
I agree to abide by all rules and regulations set forth by HCC for events and cricket tournaments. Furthermore, I agree that HCC can suspend me without any monetary refunds from any events or cricket tournaments due to disciplinary issues such as but not limited to, use of vulgar language, bullying, verbal or physical altercation, behavior that may be injurious to others, and un-sportsmanship like conduct.

I understand while participating in HCC events and cricket tournaments, I may be photographed or likeness. I grant permission to HCC to take photographs or likeness of me and to publish and use my photograph in any and all publications for any lawful purpose including, without limitation, publicity, illustration, advertising, and Web content. I waive the right to inspect or approve of the finished product, including written or electronic copies of my photograph or likeness. Additionally, I waive any right to royalties or other compensation arising out of or in any way related to the use of any photograph or other likeness of me or my image.

I understand that as a captain of the team, no one under the age of eighteen should ever be allowed to play from my team’s side and no player should be allowed to play without signing this Accident Waiver and Release of Liability Agreement first. If as a captain of a team, I fail to follow these mandates, I assume sole responsibility of all eventualities that may arise from my failure to follow these requirements.

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from HCC events and cricket tournaments, THE FOLLOWING ENTITIES OR PERSONS: HCC, HIC, ALL IN HCC and HIC, and/or HCC managing organization members, HIC Chairman, HIC Board Members, volunteers, umpires, sponsors, observers, committee members, employees, players, directors, organizers, officers, agents, suppliers, contractors, subcontractors, arbitrators, and spectators.

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in (A) from any and all liabilities or claims made as a result of participation in HCC events and cricket tournaments, whether caused by negligence or otherwise.

The accident waiver, release of liability and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS AGREEMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS AN ACCIDENT WAIVER AND RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.
