Element of Risk:
Like all sports, the game of Cricket involves the risk of physical harm as a result of play. While protective equipment is worn and care is taken to avoid injury, participants may be injured in a number of ways, including by being struck by the ball; from running between the wickets or fielding; in a collision with other players, the boundary or the stumps; through repetitive strain type injuries and through injuries resulting from the failure of equipment. Players may be injured during official matches played in the OVCC league, while representing the OVCC league in representative games, during practice with an OVCC club team, as well as through any travel to and from competitive events or participation in non-competitive events which are an integral part of a club’s activities, as well as other related events and activities (referred to together as “Cricket Activities”). These injuries result from the nature of the sport of cricket and can occur without any fault on the part of the Ottawa Valley Cricket Council (including its member clubs) (the “OVCC”), the Rideau Hall Cricket Association (the “RHCA”), the National Capital Commission (the “NCC”) and the City of Ottawa, or their respective directors, officers, servants, employees, volunteers, officials, coaches or agents (all of which are collectively referred to in this document as the “Representatives”). By choosing to participate in the Cricket Activities, you are assuming the risk of injury both known and unknown, even if arising from the negligence of the Representatives, and assume full responsibility for your participation.
Acknowledgement and Release – Adult Players
In consideration of being allowed to participate in the Cricket Activities in 2014,
I, ....................................................................................................... (print) on behalf of myself and my heirs, administrators, executors, successors and assigns, understand and accept the above and hereby release and agree to hold harmless the Representatives from any and all claims, actions or damages, without any limitation whatsoever and no matter how caused, whether consisting of loss, personal injury, property damage, permanent disability or death arising from my participation in the Cricket Activities while on the property of the NCC, the OVCC, the RHCA or the City of Ottawa, even if arising from the act or omission, breach of contract or negligence of the Representatives. As a participant in Cricket Activities, I agree to conduct myself in an appropriate manner at all times, showing the appropriate degree of respect to other persons and to the facilities at which play is conducted. I will not willingly cause, or do anything which might cause, any damage to the facilities, other players, spectators, coaches, or officials of the Representatives, or to their reputations, and agree to indemnify any of these parties for any damage I may cause to such facilities, persons and/or reputation. I agree that if I engage in behaviour which is not appropriate, I may be required to leave the premises and prevented from returning, and I may no longer be permitted to participate in Cricket Activities sponsored or provided by, or through the facilities of, the Representatives.
